SJC not to participate in working group for bill on necessary defence

Sofia. The Supreme Judicial Council (SJC) will not have representatives in a working group with the Ministry of Justice which is proposed to draft amendments to the Criminal Code in relation to necessary defence. The Council said it will deliver an opinion once a bill on the matter is presented.

Sofia. A working group will propose changes to the regulations on necessary defence to ensure protection of persons and property, Minister of Justice Tsetska Tsacheva said, referring to the protests of citizens following the arrest of Dr. Ivan Dimitrov from Plovdiv, who was charged for murdering a burglar, FOCUS News Agency reports.
“Prime Minister Borissov has requested from me and Minister Radev to consider the need, which we think does exist, to introduce changes to the regulations on necessary defense and find the right balance for protection of persons and property without violating other legal principles and norms. We will hold discussions with NGOs, magistrates, supreme judges, prosecutors, lawyers, as well as will seek the opinion of MPs and regular citizens, and in a short time a working group will propose the relevant amendments to Art. 12 and following of the Criminal Code,” Tsacheva said.

Plovdiv. The accused watched the burglary unfold for at least 30 minutes without telling anyone, including the police, District Prosecutor Rumen Popov said during a press briefing on the murder of a 38-year-old Roma man that Dr Ivan Dimitrov is accused of, FOCUS Radio reported.
“After that, the accused came down to stop the burglary holding an illegally owned weapon – Walther pistol, loaded. The burglar attempted to escape and in the ensuing struggle the accused fired his weapon once. The burglar managed to escape but was shot multiple times. He died at the scene from a single wound,” said the prosecutor.
After the shooting, the accused called a friend and asked for help – to clean up the crime scene. The latter was questioned as a witness.
The District Prosecutor also said that the accused did not cooperate with the police and even denied having committed the murder.
Today, Dr. Ivan Dimitrov will be released on bail after being held for 72 hours.
