The rules obliging small fuel traders to pay excessive amounts of money in advance to guarantee their ability to pay due VAT are incompatible with EU rules and the freedom to conduct a business, namely Council Directive 2006/112/EC and Article 16 of the Charter of Fundamental Rights, the Commission said.
Besides, Bulgaria is asked to change its rules for VAT calculation for business assets used for private or non-business purposes or transferred to another EU country.
If Bulgaria does not take steps within the next two months, the Commission may send a reasoned opinion to the country.
